In 2016, Obama could have just named Merrick Garland to the Supreme Court. Claimed the Constitution said the Senate could “advise and consent” and since the Senate failed to advise and consent he was going to go ahead and fill the vacancy.
On January 6, 2017, Hillary Clinton could have held a rally at the Ellipse and told her supporters that the Electoral College is undemocratic and since she got 3 million more votes than Donald Trump she is the rightful winner of the election and incited a riot upon the Capitol to block the certification of the election results.
In 2021, Joe Biden could have replaced Breyer with five 30-year-old Democratic loyalist Congressional staffers. Claimed the Constitution doesn’t specify how many justices the Supreme Court has and the nation has grown so much the Supreme Court should be 13 justices instead of 9.
None of those things happened.
